a. Dyna-Glo may allow users to submit product ratings, reviews, photos, videos, or other commentary. Dyna-Glo does not claim ownership of any intellectual property rights over user generated content.
b. By submitting user generated content, you grant Dyna-Glo a worldwide, perpetual, irrevocable license to publish, display or use that content across its website, marketing or promotional material.
c. Dyna-Glo reserves the right to edit or remove any user generated content at its discretion without notice or reason.
6. Affiliate Disclosure & Links
a. Dyna-Glo may allow third parties to host product links or advertisements on thedynaglo.com. Any purchases through those links provide advertising fees or commission to Dyna-Glo at no additional cost to the user.
b. Dyna-Glo site contains links to third party websites. Dyna-Glo is not responsible for the content or privacy practices of those sites which are subject to their own terms of use and privacy policies.
7. Product Pricing & Availability
a. All prices displayed on the Dyna-Glo website are quoted in U.S. dollars. Published prices do not include sales tax or shipping costs which are calculated at time of checkout.
b. Dyna-Glo strives to display accurate product specifications, pricing, and availability. However, errors may occur. Dyna-Glo reserves the right to change product information, specifications, and pricing at any time without notice.
c. Special promotions and discounts are valid for limited periods at Dyna-Glo’s discretion and subject to any additional terms and conditions associated with the offer.
8. Order Acceptance & Returns
a. Completion of an online order form does not secure a final sale. All orders are subject to acceptance and availability confirmation by Dyna-Glo.
b. Dyna-Glo fulfills orders based on inventory availability. If your product goes on backorder you will be notified by email. You may choose to wait for stock replenishment, request substitution for a similar product if available, or cancel the backordered item for a full refund.
c. For most products sold directly by Dyna-Glo, you may return unworn, unaltered items in new condition and original packaging within 30 days of receipt for a full refund or exchange. We do not accept returns on final sale or clearance merchandise.
9. Payment, Taxes & Shipping
a. Dyna-Glo accepts Visa, MasterCard, American Express and Discover credit card payments. Where available, users may also pay through PayPal or Apple Pay.
b. Online credit card payments are processed through industry standard third party payment gateways. Dyna-Glo does not have direct access to or store complete credit card data.
c. Users are responsible for any sales tax, VAT, or duties associated with product orders. If you are tax exempt, you must provide a valid exemption certificate.
d. We ship to addresses within the United States and US territories including Puerto Rico, U.S. Virgin Islands, and Guam. Expedited or international shipping may be available at additional cost. Contact us for delivery quotes.
e. Title and risk of loss transfer to you upon our shipment of a product. Customers may track the shipping status for all orders placed directly through Dyna-Glo. We are not liable for any lost shipments when using third party carriers.
10. Account Registration
a. You can browse the Dyna-Glo website without registration. However, you may need to create an account to complete product purchases or access special content.
b. When registering for an account, you agree to provide current, accurate, and complete information about yourself as requested on the sign up form.
c. You are solely responsible for any activity occurring on or through your user account. Keep your account password confidential. Inform us immediately of any unauthorized account use.

c. Dyna-Glo shall not be liable for any compensatory, indirect, incidental, special, consequential or punitive damages, losses or expenses arising directly or indirectly from your use of the website or products.
d. You assume total responsibility and risk for your use of this site and products. Your sole remedy against Dyna-Glo for dissatisfaction is to stop using the website or product.
e. Dyna-Glo’s total liability arising from or relating to these terms shall not exceed one hundred U.S. dollars ($100).
13. Warranty Disclaimers
a. DYNA-GLO MAKES NO EXPRESS WARRANTIES OR CONDITIONS BEYOND THE LIMITED PRODUCT WARRANTIES SPECIFICALLY PROVIDED WITH YOUR PRODUCT PURCHASE.
b. DYNA-GLO DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
14. Dispute Resolution
a. These terms shall be governed solely by the internal laws of the State of Illinois without regard to conflicts of laws principles.
b. Any legal action arising from or related to these terms must be brought exclusively in a state or federal court located in Cook County, Illinois. You consent to the personal jurisdiction and venue of such courts.
15. Modification & Severability
a. Dyna-Glo reserves the right to amend these terms at any time. Amended terms shall become effective upon posting to thedynaglo.com. Your continued site use constitutes agreement with revised terms.
b. If any provision of these terms is deemed invalid or unenforceable under applicable law, the remaining provisions shall still apply to the greatest extent possible.
16. Entire Agreement
This document constitutes the entire agreement between you and Dyna-Glo relating to use of this website and products. This agreement supersedes any prior representations, discussions, undertakings, communications, or advertising with respect to thedynaglo.com and products.
